Michael Chappell, the chief administrative law judge of FTC has taken an initial decision on biodegradability claims. He states that ECM Biofilms, the producer of plastic additives has violated the rules of FTC act. FTC has been failed also to prove that ECM has implied that the plastic additives developed by them will be degraded in a landfill within a year. Michael writes that the test on the basis of which ECM trusts to be competent and reliable evidence demonstrated that the plastics developed by ECM are compostable. ECM has not achieved success in proving that these claims are false.

According to the complaint filed by FTC in 2013, the biodegradability claim by ECM is false and misleading. Further, FTC states that ECM advertises it’s plastic additive as an element that makes plastic degradable. Through fliers, brochures and online resources the company is convincing it’s customers that the product it is selling as MasterBatch Pallets can make plastic products compostable.
As per the initial decision by FTC, the ECM claimed that the plastic products developed by the company can be degraded in a landfill within the period of 9 months to 5 years. Further FTC states that these claims are violating section 5 of FCT act.
